Creditors whom you have not paid can petition a court to initiate bankruptcy proceedings against you. Also, individuals can apply for their own bankruptcy online; the fee is £680. In almost every case, the disadvantages tend to outweigh the possible advantages. We recommend taking professional advice at the earliest opportunity.

If you receive a statutory demand, you have eighteen days to apply to the court to have it set aside. 

Valid grounds for your statutory demand to be cancelled include:

  • The statutory demand is incorrect.
  • You owe less than £5,000.
  • The creditor owes you as much as you owe them (a counterclaim).
  • You have a genuine dispute with the creditor(s), e.g. for goods not received.
  • You have a valid legal defence, such as late action by the creditor.

Additionally, you can apply to have a demand set aside if the amount owed is secured against your belongings or home. However, secured loans mean creditors can repossess the goods, property or vehicle. 

Homeowners with equity in their residential property risk losing their homes through enforced sales. That is why it is worth exploring all the options before applying for bankruptcy. 

If you are a tenant, landlords can evict you if your rent payments are in arrears.

Usually, motor vehicles are sold and the proceeds are reserved for paying debts. Exceptions include if you own the vehicle and it is essential for your work, basic domestic needs or caring for a disabled relative because other transport is unavailable.

If the official receiver exempts your vehicle, you remain liable for road fund licence payments, MOT tests and motor insurance. Also, if the car is valuable, it may be necessary to sell it and obtain a cheaper alternative. The money raised goes towards debt payments. 

Bankruptcy excludes working as an accountant, solicitor or finance professional.

You cannot act as a company director. There are implications if you run your own business, which might have to go up for sale if it has equity. 

Usually, newspapers do not publish the names of bankrupt individuals unless the case involves public concern or financial misconduct.

Two websites list bankruptcies: the Individual Insolvency Register (IIR) and The Gazette. Details include individuals’ names and addresses. If you are concerned about risks to you or your family, excluding address details from these listings may be possible.
